STORYLINE: National Commission for the Independence of the Judiciary and the Rule of Law “Istiqlal”, based in the city of Ramallah in the West Bank, issued a monitoring report on the extent to which the accused’s guarantees are respected during arrest procedures in the Palestinian Magistrate Courts. The report stressed the necessity of creating the position of an arrest judge to be appointed in each court whose task is to consider the prosecution’s requests. The public may arrest or extend the detention of accused persons, consider bail applications, and inspect prisons. Human rights activists who participated in a workshop to discuss the report in the city of Ramallah confirmed that arrest procedures differ according to their background, as in criminal cases they are more transparent, while in cases of a political nature they are marred by legal and procedural violations.
